1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Cyber Alamo ("Company," "we," "us," or "our") concerning your access to and use of the Cyber Alamo website and services, including our Red Team and Blue Team cybersecurity platforms (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Acceptable Use

2.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. Our penetration testing and security assessment tools must only be used:

• On systems and networks you own or have explicit authorization to test
• In compliance with all applicable laws and regulations
• With proper authorization from system owners
• For legitimate security assessment purposes

2.2 Prohibited Activities

You agree NOT to:

• Use our Services to conduct unauthorized penetration testing
• Attack, harm, or exploit any systems without authorization
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or malware
• Attempt to gain unauthorized access to our Services
• Interfere with or disrupt the Services or servers
• Use automated systems to access the Services without permission
• Resell, sublicense, or redistribute the Services

3. Account Registration

To access certain features of our Services, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription and Payment

4.1 Subscription Terms

Our Services are offered on a subscription basis. Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on the plan you select.

4.2 Free Trial

We may offer a 14-day free trial. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

4.3 Payment

You agree to pay all fees associated with your subscription. All fees are non-refundable except as required by law or as otherwise stated in these Terms.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

5. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Cyber Alamo and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes only.

6. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to our collection, use, and disclosure of your data as described in the Privacy Policy.

You retain ownership of any data you submit to the Services. You grant us a license to use, process, and analyze such data to provide and improve the Services.

7. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Services will meet your requirements
• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from the Services will be accurate or reliable
• Any errors in the Services will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CYBER ALAMO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cyber Alamo and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your unauthorized use of penetration testing tools

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.
